Terms of Use
These Terms govern the Salinity website, mobile app, account, cloud dashboard, NMEA 2000 data features, previews, exports, sharing tools, and related services. The short version: Salinity is an informational recordkeeping and decision-support tool—not the captain, navigator, emergency system, mechanic, or manufacturer.
Boating can cause property damage, environmental harm, serious injury, or death. Salinity can be wrong, late, incomplete, unavailable, or misunderstood. Never depend on it as your only source of navigation, vessel condition, maintenance, weather, tide, collision avoidance, or emergency information. The person in command remains responsible for the vessel at all times.
1. Agreement and who we are
These Terms form a binding agreement between you and the owner and operator of the Salinity service identified as “Salinity” in the applicable app-store listing, order receipt, or subscription record (“Salinity,” “we,” “us,” or “our”). By creating an account, selecting an acceptance checkbox, accessing a paid feature, or continuing to use the Service after notice of updated Terms, you agree to these Terms and acknowledge the Privacy Policy and Safety & Installation Notice.
You must be at least 18 and legally able to enter this agreement. If you use Salinity for a company, vessel owner, charter operation, employer, or other organization, you represent that you have authority to bind it. If you do not agree, do not install, connect, or use Salinity.
2. The Service and product status
Salinity may provide boat and equipment profiles, trip history, maintenance records, chart context, marks, conditions, planning, safety records, NMEA 2000 readings, learned operating groups, notifications, diagnostic-event records, cloud synchronization, file storage, and owner-directed sharing. Feature availability depends on release status, plan, region, device, permissions, network connectivity, gateway, vessel configuration, and data actually published by connected equipment.
Anything labeled demo, example, preview, beta, field validation, experimental, or roadmap may be incomplete, simulated, materially changed, or withdrawn. It must not be treated as a promise that a feature will launch or perform in a particular way. Salinity does not promise compatibility merely because a brand, engine, gateway, chartplotter, sensor, or protocol is named.
3. Captain and operator responsibility
You—not Salinity—are solely responsible for the vessel, voyage, crew, passengers, cargo, legal compliance, lookout, speed, route, fuel, seaworthiness, maintenance, and every decision to depart, continue, alter course, operate equipment, or seek help. Use good seamanship, maintain a proper lookout, obey applicable navigation rules, carry required equipment, and follow official charts, notices, manufacturer alarms, manuals, service bulletins, and directions from authorities and qualified professionals.
Salinity is not approved as a primary navigation display, electronic chart system, engine alarm panel, remote-control system, fire or bilge alarm, medical device, or regulated distress system. It does not assume the duties of a master, owner, operator, installer, surveyor, dispatcher, mechanic, marina, manufacturer, Coast Guard, or other authority.
4. Navigation, weather, tides, and local information
Maps, chart layers, tracks, depths, hazards, tides, currents, weather, regulations, closures, fuel range, and route information may be delayed, generalized, incomplete, inaccurate, or unavailable. They may come from third parties and may not be official or current. Salinity does not provide collision avoidance or guarantee safe clearance, depth, weather, route, arrival time, or regulatory compliance.
Before and during every voyage, independently verify conditions and navigation information using current official sources and appropriate marine equipment. Electronic records never replace situational awareness or the mariner’s obligations under applicable navigation rules.
5. Emergencies
Salinity is not an emergency service and does not guarantee that any distress message, float plan, location, contact, or alert will be sent, received, monitored, or acted upon. The app, phone, internet, GPS, permissions, battery, or cloud service may fail. Do not substitute Salinity or a cellular phone for required or appropriate VHF/DSC radio, EPIRB, PLB, AIS, sound signals, visual signals, or other recognized maritime safety equipment. In an emergency, use the recognized distress systems and emergency contacts for your location.
6. NMEA 2000, gateways, and installation
Salinity may read data made available through compatible third-party gateways and vessel networks. Unless a particular release expressly says otherwise, Salinity is designed to be read-only and not to command propulsion, steering, switching, or vessel equipment. You must confirm that every device and connection is approved for the vessel, network, intended use, and environment.
Installation, modification, power, fusing, cabling, backbone design, termination, grounding, isolation, weather protection, configuration, and troubleshooting must follow current manufacturer instructions, applicable law, and applicable NMEA/ABYC or other professional standards. Use a qualified marine electronics installer or marine electrician where appropriate. Salinity does not install, inspect, certify, or warrant a gateway or vessel network. Improper installation can disrupt shared data, damage equipment, drain batteries, create fire or electrical hazards, or deprive the operator of critical displays.
NMEA 2000® is a registered trademark of the National Marine Electronics Association. Other names belong to their owners. References describe potential interoperability only and do not imply affiliation, endorsement, certification, sponsorship, or universal compatibility.
7. Vessel data and learned operating groups
Connected data can be missing, duplicated, delayed, corrupted, mapped to the wrong engine or device, expressed in unexpected units, affected by sensor or gateway faults, or unavailable when the phone is offline or background access is restricted. Proprietary messages and gateway translations vary. Multi-engine labels, fuel use, range, trip boundaries, and device identity must be checked by the user.
“Normal,” “expected,” “outside,” “irregular,” learned ranges, grouped samples, and similar labels describe statistical patterns in recorded data. They are not manufacturer limits, proof that operation is safe, a diagnosis, or a statement that equipment is healthy. More trips may improve the available pattern but do not eliminate error. A condition can be dangerous while still resembling prior trips; a harmless condition can look unusual. The absence, presence, timing, or wording of an alert must never override an equipment alarm, manual, inspection, professional advice, or your observations.
Phone, smartwatch, anchor, depth, tide-margin, engine, electrical, device, and remote alerts are supplemental. Notifications can be late, missing, duplicated, silenced, disconnected, or based on inaccurate data. Acknowledging an alert does not mean the condition has cleared. You must independently set and verify thresholds, maintain a proper lookout and anchor watch, preserve safe under-keel clearance, and keep required and manufacturer-provided alarms operating.
You are responsible for validating device assignments and units, investigating inconsistent readings, maintaining independent records and backups, and stopping or reducing operation whenever prudent. Never create a dangerous condition to reproduce an event for Salinity.
8. Mechanic Live and maintenance information
Mechanic Live, incident records, timelines, fault codes, service reminders, parts fields, and exports are recordkeeping and communication aids. They are not a diagnosis, inspection, repair authorization, warranty determination, or representation that a part, tool, technician, or repair is correct. A mechanic must independently inspect the vessel and confirm part numbers, serial numbers, procedures, safety precautions, and final repairs using authoritative manufacturer information.
Maintenance reminders can be missed or calculated from incomplete data. You remain responsible for manufacturer schedules, recalls, inspections, consumables, winterization, legal requirements, and seaworthiness. Salinity is not responsible for work performed or omitted by an owner, installer, mechanic, marina, or other third party.
9. Accounts, permissions, and security
Provide your accurate legal name, date of birth, home address, and email; keep that information current; protect credentials and devices; use reasonable security; and notify us promptly of suspected unauthorized access. You represent that you are the person identified in the account agreement record. Those user-provided entries establish your representation and acceptance record but are not a promise by Salinity that identity was independently verified. You are responsible for activity under your account and for ensuring you have the vessel owner’s permission to connect, record, upload, or share vessel information.
Each individual account may have one active primary phone installation at a time. Activating a replacement phone revokes the prior installation’s mobile access. The website dashboard and a companion smartwatch operating through the active phone do not consume another phone slot. You may not share credentials, copy device keys or signed-request material, falsify installation identity, bypass activation, or otherwise evade an account, seat, or device limit. Device controls reduce abuse but do not guarantee that a compromised account, device, operating system, or network will be detected or prevented.
Family Pro consists of one Family Owner Pro account and no more than three invited Family Member Pro accounts. Every member must be an adult family or household member, accept the Terms through a separate Salinity account, and use their own credentials. Invitation tokens are private, email-bound, expire, and may be revoked. The owner controls payment and membership; a member must leave the current family before subscribing as a Family Owner Pro. Removed or departed members lose the family entitlement but keep their separate account subject to the plan then applicable to it. To discourage rotating shared access, the owner may replace no more than three members in a rolling 12-month period unless Salinity approves an exception.
Do not collect or disclose another person’s location, medical details, contact information, communications, or other personal data without a valid reason and any consent required by law. Limit access to emergency plans and shared mechanic packages. Remove access when it is no longer needed.
10. Your content and sharing
You retain ownership of content you provide. You grant Salinity a worldwide, non-exclusive, limited license to host, copy, transmit, format, process, back up, and display that content only as needed to operate, secure, improve, and support the Service and as described in the Privacy Policy. You represent that you have the rights and permissions needed for the content and its use.
When you create a link, export, mechanic package, float plan, or other share, the recipient may save or forward it. You control the selection and are responsible for reviewing the included time range, location, vessel identifiers, passenger information, notes, and files before sharing. Salinity cannot recall copies already received by others.
11. Acceptable use
You may not misuse the Service; interfere with its security or operation; upload malicious or unlawful content; access another account or vessel without authorization; falsify identity, plan, incident, or telemetry data; scrape or resell the Service; evade plan limits; reverse engineer except where law expressly allows it; or use Salinity to operate, monitor, or certify a safety-critical system for which it was not expressly approved. You may not use the Service in a way that violates law, sanctions, export controls, intellectual-property rights, privacy rights, or safety requirements.
12. Free and paid plans
Plan features, prices, trials, renewal periods, storage, and limits are shown before purchase and may change prospectively. A website subscription is processed through Stripe and renews automatically at the amount and interval shown at Checkout until canceled. You authorize Stripe and Salinity to charge the selected payment method for each renewal, applicable taxes, and disclosed fees. Cancel future renewal through the Salinity billing page and Stripe customer portal. Unless the purchase screen expressly states otherwise, cancellation takes effect at the end of the paid billing period and does not retroactively refund that period.
Individual Pro permits one adult account and one active primary phone. Family Pro permits the owner plus up to three invited adult member accounts, with one active primary phone per person. Unused family seats have no cash value, do not roll over, and cannot be resold. Ending or changing the owner’s Family Pro subscription can remove member entitlements at the end of the applicable access period.
Stripe may collect billing details, tax information, and payment-method information under its own terms and privacy policy. Salinity does not receive or store complete card numbers. We rely on signed provider events—not a browser success screen—to grant, change, or remove paid access. A payment can be pending, require further authentication, fail, be disputed, or be reversed. Paid access may be limited during unresolved payment failure and ends when a subscription becomes unpaid, canceled, expired, or fraudulent.
Google Play-distributed app purchases for digital app functionality must use Google Play Billing or another method and link permitted under the applicable Google Play program and region. Google Play purchases, renewals, cancellations, refunds, taxes, family controls, and payment methods are also governed by Google’s purchase terms. A subscription bought from one provider must be managed with that provider.
Except where law, the purchase screen, or the applicable payment provider requires otherwise, charges already paid are non-refundable and no credit is issued for partial periods or unused features. This does not limit mandatory cooling-off, refund, cancellation, or consumer rights. Contact hello@salinity.live promptly about duplicate or incorrect charges. Taxes, exchange rates, bank fees, and data or carrier charges may apply. A free feature may be changed or discontinued.
13. Third-party services
The Service may depend on or link to gateways, operating systems, app stores, authentication, maps, weather, tide, cloud, payment, connectivity, manufacturer, marina, mechanic, or other third-party products and data. Their terms and privacy practices apply separately. We do not control and are not responsible for third-party products, people, data, availability, acts, omissions, or decisions.
14. Intellectual property and feedback
Salinity and its licensors own the Service, software, design, branding, and content other than your content and third-party materials. Subject to these Terms, you receive a personal, limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. If you provide ideas or feedback, you permit us to use them without restriction or compensation, but you do not transfer ownership of unrelated confidential materials.
15. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA, ALERTS, ESTIMATES, CONTENT, EXPORTS, PREVIEWS, AND SUPPORT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND AT YOUR SOLE RISK. SALINITY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, COMPLETENESS, COMPATIBILITY, SECURITY, AVAILABILITY, SAFETY, AND THAT THE SERVICE WILL DETECT, RECORD, PRESERVE, TRANSMIT, OR WARN OF ANY CONDITION.
NO ORAL OR WRITTEN STATEMENT CREATES A WARRANTY UNLESS EXPRESSLY INCLUDED IN A SEPARATE WRITTEN LIMITED WARRANTY ISSUED BY SALINITY. SOME JURISDICTIONS DO NOT ALLOW PARTICULAR DISCLAIMERS, SO THEY APPLY ONLY TO THE EXTENT LAWFUL.
16. Assumption of risk and release
YOU UNDERSTAND AND VOLUNTARILY ASSUME THE RISKS ASSOCIATED WITH BOATING, MARINE ELECTRONICS, INSTALLATION, CONNECTIVITY, EQUIPMENT FAILURE, WEATHER, NAVIGATION, MAINTENANCE, AND RELIANCE ON DIGITAL INFORMATION, INCLUDING PROPERTY DAMAGE, POLLUTION, PERSONAL INJURY, AND DEATH. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE SALINITY AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, AND AGENTS FROM CLAIMS ARISING FROM YOUR INSTALLATION, VESSEL OPERATION, CONTENT, SHARING, OR RELIANCE ON THE SERVICE, INCLUDING CLAIMS BASED ON ORDINARY NEGLIGENCE. THIS RELEASE DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE WAIVED, INCLUDING WHERE APPLICABLE FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR VIOLATION OF LAW.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALINITY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS, OR OPPORTUNITY; VESSEL DOWNTIME; TOWING, SALVAGE, HAUL-OUT, TRAVEL, PARTS, LABOR, SUBSTITUTE SERVICES, ENVIRONMENTAL RESPONSE, OR THIRD-PARTY CLAIMS; OR DAMAGES ARISING FROM MISSED, LATE, FALSE, OR INCOMPLETE DATA, ALERTS, RECORDS, DIAGNOSES, DIRECTIONS, OR COMMUNICATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALINITY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SALINITY FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY DO NOT LIMIT LIABILITY THAT LAW PROHIBITS US FROM LIMITING.
18. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Salinity and its owners, affiliates, licensors, service providers, officers, employees, and agents from third-party claims, losses, liabilities, penalties, and reasonable costs (including legal fees) arising from your vessel operation; installation or network modification; content or sharing; misuse of the Service; violation of these Terms or law; or infringement of another person’s rights. This obligation does not apply to the extent a claim results from conduct for which indemnification cannot lawfully be required.
19. Disputes; individual arbitration
This section needs to be reviewed against the Salinity operating entity’s formation state and principal place of business before commercial launch. Before filing a claim, email a written notice describing the dispute and requested relief to hello@salinity.live and allow 30 days for an informal resolution.
Except for eligible small-claims matters or requests for temporary injunctive relief involving unauthorized access or intellectual property, disputes will be resolved by binding individual arbitration under the Federal Arbitration Act and the AAA Consumer Arbitration Rules. There is no judge or jury in arbitration, and court review is limited. You and Salinity waive jury trial and agree that claims may be brought only individually, not as a plaintiff or class member in a class, consolidated, representative, or private-attorney-general action. If this arbitration agreement is found unenforceable as to a particular claim, that claim may proceed in a court with jurisdiction and the remainder survives.
You may opt out of arbitration by emailing your name, account email, and a clear opt-out statement within 30 days after first accepting these Terms. Arbitration and forum provisions apply only where lawful and do not remove non-waivable consumer rights.
20. Suspension and termination
You may stop using Salinity at any time. We may restrict or terminate access when reasonably necessary for security, legal compliance, nonpayment, material breach, risk to people or systems, or discontinuation of the Service. Where practicable, we will provide notice and a reasonable opportunity to export user-controlled records. Sections that by nature should survive—including ownership, disclaimers, risk allocation, disputes, and indemnity—survive termination.
21. Changes, electronic records, and notices
We may update these Terms prospectively. For material changes, we will provide reasonable notice and request renewed acceptance when required. The version and effective date appear at the top. Electronic acceptance, notices, and records have the same effect as paper to the extent allowed by law. You may print or save these Terms and may request a copy by email.
22. General terms
These Terms and incorporated policies are the entire agreement regarding the Service unless a separate signed agreement applies. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder continues. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, sale, or transfer of the Service. Headings are for convenience. Nothing in these Terms waives rights or remedies that cannot legally be waived.

Questions, legal notices, arbitration opt-outs, and safety concerns may be sent to hello@salinity.live. Include your account email and enough detail to identify the issue, but do not email passwords or unnecessary medical, location, or payment information.
